Reporting to Group Legal Adviser - Litigation, Regulatory and Insurance.
You will work closely with the Group`s operating businesses, particularly with surveying, valuation, conveyancing business, plus external claims handlers and advisers.
This role is based in London, however could be based in Milton Keynes or Chelmsford.The role may involve travel and visits to various Countrywide locations throughout the country (particularly Castle Donington and Swindon)
You wil act las `in-house` adviser and business interface in relation to professional indemnity (pi) claims, particularly pi claims arising out of surveyor defects, residential valuation and conveyancing work and other property related claims and notifications.
Provide ad hoc support to the customer relations team in Surveyors and Conveyancers.
Specific pi responsibilities will include:-
Investigate and prepare responses to claims and oversee the in-house handling of claim defences within Protocol as appropriate without the need for reference to costly external panel solicitors.
To liaise with the Claims Administrator in relation to notification of complaints, coverage issues, provisions, reserving and payments.
To liaise with the Claims Administrator and CCS and CSS as required in relation to the provision of MI.
With the mind-set of a `self-insured` business, act as a central point for critically reviewing, challenging and testing the validity of claims, reserve recommendations and settlement recommendations ensuring that costs to the business are minimised at all times.
Ensuring optimal use of panel solicitors particularly in terms of cost, including negotiating terms of reference and charges; monitoring legal defence costs; allocating instructions to panel firms; analysing and critically evaluating the advice and recommendations made by panel solicitors.
Instructing and managing the relationship with Loss Adjusters and panel law firms.
Liaise with claimants (typically lenders, survey clients, purchasers, sellers) and their professional advisers/lawyers to ensure they provide necessary information and documents and in appropriate cases engage with them to resolve claims.
Assess potential liability on claims, obtain records and documentary evidence, procure retrospective valuation and prudent lending opinions, attend site inspections and robustly dispute or defend claims where appropriate.
Ensure that appropriate claims with potential to exceed mandate or issues of overriding importance to the Group are referred to panel solicitors.
To provide assistance in relation to Subject Access Requests (SARs) that often precede potential litigation.
